The Failure of the 28-Article Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency triggered by the announcement of a new comprehensive peace framework for ending the war appeared – momentarily – to have been stabilised. A American diplomat spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, Moscow made its countermove: an extensive attack of rocket attacks on Kyiv.

The Cycle of Negotiation and Warfare

The succession of opposing developments captured the harsh reality of the outgoing year. By day, diplomatic battles are fought: optimistic declarations are released from multiple capitals. Significant resources is devoted on managing certain initiatives. By night, Moscow brutally reminds the world that, for them, conflict continues to be the main instrument for achieving "settlement".

Nighttime Reality

As Russia's attack developed into the early hours of Tuesday, the immediate reality of Ukraine's exposure was revealed. Ukraine is capable of detecting missile launches from enemy soil, a capacity afforded by up-to-date information. From witness perspectives, defense planes that had been dispatched to intercept incoming guided weapons roared overhead – advanced fighter aircraft supplied to Ukraine by Western partners.

Soon thereafter, Kyiv's anti-aircraft weapons activated: defensive missiles fired to intercept a incoming threat. This was a sophisticated defense system at work, presumably delivered by partner states. Every firing jolts you unexpectedly, causing tremors. The moment of terror quickly transforms into sober acceptance: perhaps the incoming missile won't hit its mark this time, sparing the city from devastation and further power outages.

Persistent Threats

Not long after, a automatic firearm opened up on a unmanned aircraft close by, part of a mobile-fire group – almost certainly allied-provided weaponry. Regrettably, the bullets missed the opposing UAV – it pressed on overhead toward its target.

Periodically, this continued until dawn. Kyiv awoke to the daybreak reports: multiple fatalities, destruction and utility failures in many homes as a result of the night's assault. As typically, everyone still maintained normal activities – enduring hostilities. But those full day encapsulated Ukraine's essential dependence on external assistance – a dependence that neighboring countries are clearly incapable to fill in the near term.

Unsuccessful Negotiations

The 28-point plan from Washington sparked intense emotion, controversy and deep concern – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and bilateral conferences.

Every new initiative from US leadership follows the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, effectively counters. They contain the crisis but never actually achieve victory. This trend will, no doubt, endure.

Political Considerations

It is convenient to criticize certain parties of consistently pushing Russian terms. But that does not seem to be the whole story. American leadership functions according to a principle understood by international relations experts: you cannot win at the negotiating table what you have lost on the battlefield. The US administration believes that it is impossible to pressure the Kremlin to surrender the territory that it currently occupies in Ukraine's occupied territories.

The issue is that while accepting these circumstances, US leadership does nothing to discourage Russia, through words or deeds, from believing that the situation will not change more in its advantage in the coming year.

Divergent Views

Therefore, Moscow is confident that time is on his side – that Ukraine and its partners are nearing depletion. Their incentive to agree to terms that does not give them the greatest potential benefit is close to zero. There may be multiple initiatives to end hostilities, but they will continue as long as Russia's leadership remains completely certain in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still persist, gradually sacrificing lives and land but preventing a complete military breakdown until situations evolve in its advantage.

Present Conditions

Factually, there are no actual prerequisites for a armistice. Now, individual motivations are becoming relevant: leadership ambitions to mediate resolution and obtain worldwide acknowledgment, and Ukrainian leadership's double obstacles – on one hand, not to alienate a key ally, and on the other, to unite the population around the country's interests against any initiative Kyiv finds unacceptable, so that their attention does not switch to domestic problems. And although their mission will now be considerably more difficult after latest incidents, it remains quite doubtful that this will alter their fundamental strategy.

These conflicting dynamics are influencing discussions.

Assessment and Future

It took a only one week to eliminate the proposed articles of the current initiative. Aggressive and erratic handling of the matter by Washington, pushback by Ukraine and the remaining European nations, along with pacifying measures of representatives, and finally, recent disclosures, all served their function.

While new plans based on established approaches are imminent, Kyiv, London and other Western governments should arrive at a critical understanding: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are founded on Moscow's terms and show certain reluctance to alter the situation, if they maintain solidarity and improve their protective measures at a considerably quicker tempo. If they do, neither political nor armed coercion will be able to defeat them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the coming months, primarily depend on continued Western support.
